Open Threads

To the right you'll notice a new "Open Thread" box. From now on, that link will take you into the newest open thread. The threads spawn three times a day: 12am, 8am and 4pm. They'll also never close - the next thread comes at the next set time, and even after a new thread is created, the old thread will stay open. The link from the right bar will always link to the newest thread, so you shouldn't have to worry about it. An archive page is also linked to from the top of each thread so you can go back if you need to.

Hope this solves the thread problem. If it's not working out, we can re-evaluate and look at comment-count based threads or other solutions in the future. Enjoy!

Yesterday morning on MyDD, I saw a diary entitled "Welcome to Ohio Democratic Politics 101 - Eating Our Young." It included, as I expected, words about Brown jumping into the race after saying he wouldn't, but also tipped me off as to Mary Jo Kilroy's plan to run:

Saying central Ohio voters are ready to send a message of change to President Bush and congressional Republicans, Franklin County Commissioner Mary Jo Kilroy yesterday said she will run next year against GOP Rep. Deborah Pryce, of Upper Arlington.

The race will pit a proven Democratic vote-winner in Franklin County, home to most of the 15 th congressional district’s constituents, against a veteran lawmaker who is the fourth-ranking House GOP leader.

Gregg, I agree that the "Contract" was a load of crap,but people uncritically latched on to it out of disgust and frustration with Democratic hubris and arrogance.

The point is, we have to articulate and unite over a coherent message and get it out there.

Lawyers Against the War (LAW) is claiming a victory in its battle to have George W. Bush face charges in Canada for torture.

The charges stem from the notorious cases of torture practiced by U.S. forces in Iraq, Afghanistan and Guantanamo Bay, Cuba. They were laid on the occasion of George W. Bush's controversial visit to Canada in November 2004. The charges were laid under sections of the Canadian Criminal Code enacted pursuant to the United Nations Torture Convention which requires extra-territorial jurisdiction to be exercised against officials, even Heads of State, who authorize or are otherwise responsible for torture.

On Monday, the Supreme Court of BC quashed an order banning publication of everything having to do with the charges imposed when they were first laid. In a secret hearing, held December 6th 2004 in B.C. Provincial Court, the charges against Bush were rejected on the basis of arguments by the Attorney General of British Columbia that the visiting president was shielded from prosecution by diplomatic immunity. A ban on publication of anything to do with the proceedings was also imposed.

Thanks bb for posting something of value to the party! Most post only nonesense. As I was reading through the postings it looked like another day of taking up space!
The Greeks at one time sacrificed virgins to the God of Peace and Plenty! "This administration has sacrificed young men and women to the God of Democracy." Will the World think as harshly of the Bush Administration as the World thinks of the Nations that sacrificed virgins by throwing them into a volcano? There were other uncivilized Nations that sacrificed the innocent to appease their Pagen God's. While we also are uncivilized and sacrifice the Poor, young, and the uneducated. Do we think it will please our
God to sacrifice them to the God of Peace and Free Will? God allows us to do what ever we want and we have this life to learn what is that Good and Perfect Will of GOD. Do you believe if we decide it is lack of Civility to sacrifice another human with a Soul to the God of Democracy that those responsible for such decisions will be forgiven? I speak of the War in Iraq, the one in Afganstan was somewhat justified to break up their headquarters?

Inspired by this announcement, I'd like to offer the following:

Let's remember Dean's point that discussions about "god, guns and gays" are distractions from real issues.

And, it's occurred to me that we should add two more 'g's to that list--"girls" (standing for feminine healthcare issues) and "gets" (standing for what voters for one party or the other are traditionally promised they'll get in the way of tax cuts, highway interchanges, military contracts, etc. if they vote right. The focus on "gets" allows the politician to ignore questions about his/her qualifications for the office being sought, as well as such big issues like whether the U.S. should continue to build bases and set up nuclear missiles abroad.

You know, if you look closely, there's really not much difference between "nation building" and "hunting down terrorists." The mechanisms by which these goals (positive from the Democrats; negative from the Republicans) are to be accomplished are essentially the same. Which is why the call to stand down our military forces overseas is not resonnating real well in Washington. All the boys and girls have been having such a good time playing "war games" that they don't want to stop.

It is outrageous how the Republicans try and Protect the Industry, but don't care about Protecting the People! So What if children are killed or crippled. They are Dispensible to the Right, but those dollars from NRA and Colt, and S&W, etc are absolutely vital to their cause !

Compulsion? Nah, it's a comfort thing. I can't move a muscle until I've steamed the kinks out in the morning (Fibro is a buggahbear, sigh) and I can't lay head to pillow unless I feel all squeaky.

These days, with so few comforts to be had (and more taken away by the pugs every day), ya take the comforts ya CAN get.

PamB, I don't think any of them are telling a straight story...it's their way of insuring that no one can be convicted. The whole ploy sounds like a Cheney strategy to keep the grand jury from centering on any one suspect. It's a shame for him that they seem to be focused and are not falling for the leaks.

From my understanding the only reason a report is issued is when no indictments are made and no criminal prosecution is sought. At least that is how it has been explained to me. So the fact that Fitzgerald has said he will not issue a report means someone is getting charged.

The information in a report, if one were written, would only be an explanation of how nothing illegal happened and would explain how that decision had been reached. So no report is a good thing.

If anyone knows for sure, please correct me, but that is how it has been explained to me.

Ari Fleisher was reported to have read the memo that revealed Valerie Plames name, the memo with the big S that stood for secret. It was reported that Powel brought it with him on AirForce One and Ari read it and then there was a flurry of phone calls to reporters. Yes he is involved and from what I understand, he has testified to the Grand Jury.

I received an email from the RNC yesterday that was rather amusing, I logged on to the their blog (or tried to) to see what was up in kool-aid land so now I get email. They wanted me to work on a call list for one of the congressional elections!! I almost signed on so that I could use the list to tell these people NOT to vote Republican.

Good morning love. Doctors say I am fine for now. They have a new "syndrome" that they see happening with us long termers. Something like HIV Milopathy or something to that effect. I will be getting more info in two weeks. It causes nurelogical problems in long termers even with higher t-cells. It also causes those indignancies, and is also a supposed cause of my seizures.
My Nurologist is also going to have me do a relatively new test with a sub-group in Nurology, PsychoNuerologists. Four hour test much like the SAT. Whe I get more info, and have taken it, I will tell you exactly what it is called so Robear can ask his doctor about it.

They actually listen to long-termers and try to shape care around the individual needs rather than just presecribing whateverinhell they feel like. Scrambling to salvage a tough new spending reduction plan, House Republican leaders delayed a vote on deeper cuts until next week and said they would broaden their list of targets to win the GOP votes needed for passage.

The House and Senate are in the process of slicing $35 billion in mandatory spending over five years, and House GOP leaders had intended to vote today to increase the total to $50 billion. But the proposal ran into problems with conservatives, who did not think it went far enough, as well as moderate Republicans, who objected to further trims in programs such as health care for the poor and elderly, student loans, and food stamps, while discretionary spending was ignored.

Now, "everything is on the table," said Rules Committee Chairman David Dreier (R-Calif.), one of the House leaders trying to save the steeper reductions. That means even defense and homeland security spending, which had been exempted, are subject to the ax -- a key addition that House leaders hope will attract enough votes to close the deal.

Democrats noted that the cuts are only one-half of a two-part budget exercise, the second act being a new slate of tax breaks. Democratic leader Nancy Pelosi (Calif.) called the GOP's effort to further cut spending "another rip-off of the middle class to give tax cuts to those at the highest end . "

The Senate, meanwhile, is struggling to meet the original $35 billion target, established this spring in the 2006 budget resolution. The budget lays out spending reduction goals for individual committees to meet, but the heavy lifting -- identifying specific cuts -- is unfolding in Congress this month.

Sure is. I'll call my doctor and get the name of the new syndrome, and of the tests I talked about. The syndrome is relatively new in it's naming, so they might not have a clue where you are. I do live in the City that is at the heart of most of this, or at least the start of it, so sometimes info hits here first. My Primary Care told me it is considered new, and that they don't know much about people like me who have had it for twenty years. Really going out now.

I really admire that this guy was the lone senator to say no to the patriot act AND he has taken the bull by the horns and asked for a timetable in Iraq. I also like that he was a supporter of PAYGO. The more I read about him the more I like.

Although Al is not an outsider, he's been out long enough to not be a part of the dismal approval rating ALL elected officials is DC get these days. I think people are just so sick of politics as usual, the worst of which has been magnified these last long years of BushCo.

We had an outsider this time around. Look how well that turned out. NOT. I've heard my governor Mark Warner is a strong contender. Fiscal he's great but on social issues we just don't see eye to eye. He's pro death penalty. He's done nothing about protecting womens choice. I just don't see him as someone who other than economically I'd get along with. Plus he's a businessman.....no one needs to know where he'll side with little guy vs. business.

We are secure here (I'm positive) up to a Cat 3 as long as it's not sustained winds. They say it will clip along as soon as it gets turned by the upper currents.

I have a better chance staying here than I would sitting for 12 hours in a traffic jam (trust me). I worry for those on the waterfront. All those Zzzzillion dollar homes washed away. poof.

I personally don't see the storm being some huge Cat 4 or 5 being so weak as to turn so sharp and head my direction but hey who am I to say? Upper winds are upper winds. But the planet still only turns ONE way and moves at a pretty fast clip as well!

I took this opportunity to bring down the cat carrier from the upper closet and clean it out... it's been sitting on the floor in my room since yesterday and Figaro has been sticking his nose in it and then coming over to me with the cutest look. We live in sw-NY. I asked my son if he would like to have a penpal and at first was apprehensive because he did not know what one was, but then kinded of warmed to the idea. I agree this would help his third grade writing by help him write about what he's thinking. He is a great narrator, but needs reinforcement in writing his thoughts. My question, with so much ID theft and other negative stuff happening through the internet, how can we get this going?

I am glad your here because you have seen first hand the hstory that has taken place from WWII up till now. I can only recount remembering things back to say 1968-1970. Before that, I have to refer to history that my parents, and school taught me. I found that history books do not tell the whole truth, and have a lot of half-truths, or mis-truths. This I think is due to the historians politics. My dad was born in 1919 and my mother in 1921. Both seen a lot and reminded me how hard it was back in those days. My grandfather was born in 1887 If I recall, and told me more there. It pays kids to ask questions and find the truth.

Many of you probably already know Ed Schultz, a prominent progressive radio talk show host who is syndicated nationwide. You may not know what happened this week though.

After being told that the first hour of Ed Schultz's daily radio show would air live on Armed Forces Radio every day, the Pentagon suddenly reversed the decision and refused to air Ed's program Monday morning, only hours before the first show would have been broadcast. The explanation for this sudden reversal seems weak.

Last year, Sen. Tom Harkin (D-IA) introduced a resolution that was unanimously passed by the Senate, urging Secretary Rumsfeld and Armed Forces Radio to ensure more political balance in programming. Then, at the end of September, Manny Levy, Chief of the Radio Division of the American Forces Network Broadcast Center, advised Schultz's distributor, Jones Radio, that: "AFN Radio has squared away everything on our end to begin carrying the first hour of 'The Ed Schultz Show' each day, beginning Monday, October 17, 2005."

But suddenly, at 7 am on Monday the 17th, Allison Barber, the Pentagon's deputy assistant secretary for internal communications -- the same person who was responsible for staging last week's ill-fated video conference between President Bush and American troops in Iraq -- called Schultz's producer. Without any further explanation, she simply said that the deal was off.

We must let our voices be heard and exercise leadership to help ensure that the spirit of Senator Harkin's resolution -- and the spirit of fairness -- are at play on taxpayer financed programming.

It was just 11 years ago when 70 Republican Members of Congress, led by then Congressman Robert Dornan (R-CA), demanded that President Clinton's Secretary of Defense Les Aspin broadcast Rush Limbaugh's radio and television programs to the military.

Well if Armed Services Radio is good enough for Rush Limbaugh, it's certainly good enough for Ed Schultz.

The youngest one of us so far is Jen at 37. I highly doubt we'll see an age in the 20's. I have been active in politics since I could first vote. My first vote was against Regan for his 2nd term. In Kentucky, we had the voting machines with the levers. In those, you could pull one lever and vote straight Democrat which I did. I wish we had those machines everywhere instead of having to pick through everyone. By picking through, if your not for sure of ones politics, you could accidentally vote for a republican. Here in Ohio at one time, with the punch card type votes, they didn't tell what their politics were, just gave their name and what they were running for. They should be forced to put a (D) or (R) after each name.

It seems like the Pentagon has a problem with FOLLOWING DIRECTIONS. They are supposed to be paying for armor, they are supposed to be allowing multiple viewpoints and yet neither is being followed. I think Ed should sue for enforcement. I also think that some of the soldiers families should get together and get a class action going. Obviously the judicial or law ENFORCEMENT branch needs to be involved since the DoD seems to want to do it's own thing. I'm not usually a big lawsuit advocate but I do believe that if folks ignore laws that they should be penalized.

I seen on his warrent that the bail was $510,000 which menas giving the bail bondsman $51,000. 10% is the usual amount for the bondsman. That is money he wont get back! That will make me sleep better knowing that has to come out of his pocket. Surely, they wouldn't let him out on his own recognacence. If they were to, they wouldn't have shown the bail amount on the warrent?

New York also has the lever machines, but I don't think there's one lever you can pull to vote a straight-party ticket.

My first vote was also against Reagan in '84, but at the time, I was a college student attending school out of state. So I voted absentee on a paper ballot while I was home on fall break. My first time in the voting booth, years later, it took me forever to figure out how the levers worked. I would've been completely lost but for the fact that my father had taken me to vote with him once when I was a kid, and I vaguely remembered how it worked.

New York does require party affiliation to be listed on the ballot, but is also one of the few (the only?) states that permits cross-endorsement, i.e., a candidate can be endorsed by more than one party. Occasionally you even see Democrats and Republicans endorsing the same candidate (usually for a position like town justice or something). When that happens, I'll vote for the candidate on the Democratic line, just so that, if he/she is paying attention, he/she will know where the votes are comng from and what expectations are.

Clinton was skilled at addressing specific issues that people could FEEL. The above are pretty high brow issues that I'm afraid, although important, won't connect with people.

I agree that high brow issues won't connect. My point in the post was that we need values and issues and I presented these ideas as a possible set of values. Someone else suggested privacy and I think inclusivness belongs in here somewhere, but I worry about the list getting too long.

The Republicans have clearly understood values which include strict construction, small government, military solutions, faith-based leadership, and America first. Obviously, they don't uphold their own values, but the mainstream still takes them for granted. What's more, the Republicans present us valueless and in opposition to all their values.

In order to innoculate ourselves from this tactic we need clearly understood values of our own. I'm not saying it has to be this list, but it needs to be something and I wanted to get the ball rolling.

I was in college during election time. Lots of the kids from the left were really passionate. We almost had a knock down drag out in public speaking class because we had a guy do his public speaking on the case for deposing Saddam in Iraq (previously one of the speakers did one on the bogus intelligence being used for the war. Silly me I asked if the guy saying that giving the Iraqis freedom was a viable argument for war did that mean he supported the draft because the world was full of evil dictators? Which prompted the female opposition to war person into asking why he was not over in Iraq. It got heated enough that the proctor/instructor stopped the discussion. I'm such a troublemaker.

That bond amount shown though on the warrent could have been 5 = $, but there was no bar through the middle to indicate a dollar sign, and the top was flat and bottom round like a 5. It's a little grainy but I zoomed in and it still looked like a 5 to me. $10,000 just sounds awful low for the crime he did. They generally throw the book at you over this, and DeLay would be considered a flight risk over his wealth which raises the bond amount.

I thought the whole point of not having parties listed on local ballots was so candidates would be elected by merit rather than party affiliation. I know this is wildly idealistic for several reasons. I don't complain about the no party listing rule since it makes me actually go and find out about the candidates. I get wrapped up in national and world events and don't know much about local candidates.

At the end of the day I would still prefer to teach people to think critically and get informed than provide the crutch of party-line voting. I know I'm being idealistic but if we don't set goals we don't get results.

For the record I'm 36. If we want young people to blog we have to set up a way to do it with cell text messaging.

Both my daughters, now ages 17 & almost 21, have been involved in politics there whole lives. I remember taking them to democratic club meetings when they were babies. They have walked in parades and stuffed candidate envelopes for over 10 years, know all local dem. candidates by name, the oldest has worked the polls the last 3 elections and is now running for village council in her timy hamlet.

Hubby can tell you about a spitting contest me and his old CO got in when he tried to force my hubby to run on a bad knee. The adjectives used to describe me were "smart, pissed and attitude" Yep, that's me when you make me angry. Fortunately it takes me a while to get to that point. Remember "Globalism"? I think this was one of the key successes of Clinton we don't talk about enough, if at all. During the Clinton era we had stronger global institutions whose job was to handle global problems. They also had the effect of increasing trade and promoting democracy in nations who wanted to participate in the global community.

Global Democracy means we want to focus that concept. We want global institutions which have the power to solve problems and enforce resolutions passed in a democratic structure.

This is in opposition the the Global Dictatorship of Bush. Republicans will oppose this because it means other nations get a say in which policies go forward and how policy should be implemented. Right now the official policy of the Republicans is it's the world's job to do what we tell them to do.

I can post your list of cases if you want but I believe I can summarize their general theme in a way that wont take up too much thread space (most of the cases were 5-4 decisions involving the use of the commerce clause to justify congressional legislation/regulation).

As you know, I argued that Justice Ginsburg was an activist judge who legislates from the bench. I stand by that comment. Others may disagree that but they cannot disagree that Justice Ginsburg consistently uses the commerce clause to justify the constitutionality of congressional legislation/regulation, even though the legislation/regulation may or may not deal with interstate commerce. The best case that illustrates this US v Lopez, which shot down part of the Gun Free School Zone Act.

In this case, the majority found that the Gun Free School Zone Act was unconstitutional primarily because it had nothing to do with regulating commerce. Justice Ginsburg joined the dissenting opinion and argued unsuccessfully that Congress could use the commerce clause to justify the act. In my opinion, this is a clear case of judicial activism.

Just because you believe that a law is a good idea doesn’t mean that it is constitutional.
If you want me to cite the other cases I will but I think you see where I am coming from.

WASHINGTON — New Hampshire Republican Sen. Judd Gregg has won $853,492 in the Powerball lottery. D.C. Lottery officials handed the senator an oversize check for the full amount when he went to stake his claim at the lottery office on Thursday.

Gregg bought $20 worth of tickets at a Citgo gas station in Washington, D.C. He said he was driving by and decided to buy some gas, and he doesn't usually play the lottery. Gregg later added that he bought the winning ticket on Monday when he was on his way from Baltimore, Md., to the Capitol, where a vote was being held.

He said he nearly walked off with three of the four pages of numbers before the cashier called him back for the last page. He said he believes that page held the winning ticket.

Wednesday's jackpot was worth $340 million, the largest in the game's history. One ticket sold in Oregon matched all six numbers drawn in Wednesday's lottery. More than 4.4 million other people shared $34 million in smaller prize handouts.

Though Gregg will have to pay about 35 percent of his earnings in federal income tax, New Hampshire, where he files his taxes, will not get a chunk of the money.

"We have no taxes in New Hampshire. No sales tax, no income tax. All you should come up there, spend some time, enjoy yourselves," he said, adding that he's not going to be quitting his job because of the winnings.

Looks like the lowest age on here so far is 27. Most are in the mid-30's to 50's. Afterwards only one 71 I've seen. I think we may need to work the younger ones (18 to 30) to get them to drop by here as I know they're online as much as us in the evenings. The older though, some don't have computers yet or they're not used to doing this. I know this from my family about who does and doesn't. Say mid-50's-60 and up, they dont have or wish to use a computer. I'd like to see the whole age spread get involved as much as possible. I'm wondering if some hand out invitations to our blogs, and the Democratic websites at colleges and universities would help? I would think if we get them here, we could enlighten them into how important this is. I would like to see them come here and ask questions, all they could think of. I for one would be glad to talk to them and let them know our past history. The more the truth gets out, the better off we are.

My thoughts about wanting to keep people from suing the gun companies is no they shouldn't. We have to remember, they didn't pull the trigger, a criminal did, not the manufacturer. If we was to have this in law, it would make it easy for others to follow suit like someone being killed in a car wreck, and suing an auto manufacturer when someone else caused the wreck. All their attorney would have to do is cite this law as the same thing. In my opinion, the only way to sue a manufacturer would be if their product was faulty and caused bodily harm to the purchaser. Suing just because someone was shot with a gun they made takes things a little too far. I think they have the laws now where they need be with the Brady law, and that's where it should be left. I don't want to see this potential law effecting other laws which it would for the worse instead of the better.

Obviously Ginsberg had a point when she took the position that the use and possession of firearms could have financial consequences or the stupid conservatives who are too busy protecting gun manufacturers to bother with working on health care for the millions of average Americans who don't have it. Why? Follow the dollars. However, Frostie you go on thinking that Congress is protecting YOU with these laws and that Justices like Ginsberg are "wrong" for America because they are "liberal" (banging my head on the desk because the average American just doesn't get the GOP could care less about them, they just worry about the money)

As a matter of fact, I made a batch of buckeyes to take to that party for the soldier home from Iraq! My daughter told me he loved peanut butter and chocolate, so I made a large box of those and he stood and ate half the box.

My age, I think most people know. I am 63 !
I have witnessed a lot of politics and elections so when the young yahoos come in and act like they suddenly know it all, I have to chuckle.


Will, I know that Local Dem outfits have Young Democrats depts,. My own Ct has a "30 Something Dems" dept too. We have had a few from time to time, but never stay. Don't know what the trick would be to get some in here. Rose's son is a member of his town Dems. Roll that idea by her and see if her son would tell her what it would take for him to be interested here.

I shut down the oven around Memorial Day, (usually before) and don't turn it on again until 1 week before Thanksgiving (It's a new-ish {4 years} top of the line GE {{UGH}} thingy, bought on sale), just to make sure it works for the bird.

I have more than 1 grill, and use them every day. I also have the stove top, and a microwave, a Foreman Grill, Toaster Oven, Hibachi, et al, and use them. And, there is always my favorite recipe book:

Will, I know you love to research a lot, so here is a site with a bunch of Lawsuits against Gun Manufacturers. None appear to be petty or small, like a cup of hot coffee in one's lap.

And, IMO, if a Gun company cannot make enough money from normal, regular guns, but must make Machine Guns for personal use, and armor piercing ammunition , then they deserve to be sued. Don't they have consciences? By putting these items in the hands of people, they are an accessory to the murders that result.

I agree with the line item veto too, but on June 25, 1998, the Supreme Court, ruled that the line-item veto was unconstitutional. And with more conservatives being appointed to the bench I do not see this ever happening.

I remember when the republicans let the Brady law die. That was the one they should have kept going which I thought was one of the best pieces of legislation to date on firearms. I guess the way the republicans see it, they want anyone to be able to buy a gun without any form of a background check. There's just too many nut cases out there that don't need to own one. The Brady law, or a new one like it, will never see daylight again until we take over congress and the Whitehouse. Suing the gun companies goes just a little too far in my opinion. The government should be watching more who has access to them which the Brady law did somewhat. The thing is, if somebody is going to kill someone, they're going to do it with some type weapon being it a gun, knive, club, or automobile. Banning guns will not stop murder, and a criminal will find something else to use.

Another thing is assult weapons like the military rifles and or police weapons. Those do not need to be in the publics hands at all. They were made for one thing, to kill another human being at close quarters. There not worth a crap as a hunting weapon. They can also be easily modified with kits to change them into full automatics. These kits are advertized in shooting magazines and on the internet.

Now hunting rifles, shotguns, pistols, and revolvers made for civilian use I have no problem with as long as everything is done above the table. Sporting rifles are designed, and made for long range shooting of game. Shotguns with modified or full choke are used for hunting, not the sawed off cylinder bore barrels with extended magazines. Anybody that knows anything about hunting would NOT want a riot gun to hunt with. Pistols, and revolvers are for one thing, self protection. However I used to hunt with a 22 cal pistol when coon hunting. They were way lighter than packing a rifle. There's also some big game hunting done with large bore pistols and revolvers like bear and wild boar.

I could also see some manufacturers closing their doors which make guns. The fear of a lawsuit to them, or a suit itself could bankrupt a company, thus causing a good number of jobs to be lost. In small states like Connecticut, that would be a very bad thing for employment.

No, any other manufacturer could be sued over a law like this. What if someone bashed another over the head with a VCR and killed them? Should the VCR manufacturer be sued? No they shouldn't, but the VCR was used as a weapon the same as a firearm could have been. Believe me, an attorney could use that law to his advantage on any other case by citing the judgement.

And, IMO, if a Gun company cannot make enough money from normal, regular guns, but must make Machine Guns for personal use, and armor piercing ammunition , then they deserve to be sued. Don't they have consciences? By putting these items in the hands of people, they are an accessory to the murders that result.

Your correct, there should not be any way a civilian could get their hands on an assult weapon or armor piercing ammo. On the other hand, I dont see them being able to sue a manufacturer who strictly made weapons to sell to hunters. Even if the did make assult weapons, as long as they wasn't sold to the general public, that would be okay to me. Assult weapons, and armor piercing ammo, should only be available to our military and police.

I've yet to hear whether the special prosecutor Patrick Fitzgerald has interviewed former Deputy Defense Secretary Paul Wolfowitz (now chief of the World Bank).

It was widely talked about that he and Vice president Dick Cheney were the principle proponents and architects of the Iraq War (Bob Woodward, "Plan of Attack"; Richard Clarke, "Against All Enemies"). He and Cheney were constantly in the president's ear about it.

As Clarke wrote, Wolfowitz was constantly pressing the theory by Laurie Mylroie, which she wrote about in a book that the first world trade center attacks in the early 1990's and 9/11 were connected and Saddam Hussein was the one responsible ("The War Against America -- Saddam Hussein and the World Trade Center Attacks: A Study of Revenge"; and another book co-written with Judith Miller "Saddam Hussein and the Crisis in the Gulf").

As Clarke writes, the theory has been "largely discredited," yet Wolfowitz and Cheney were doing everything they could to find a connection -- anything -- that would help them justify an Iraq invasion. Cheney was salivating at the idea so much that he made regular frequent visits to the CIA, constantly hounding analysts to find phantom connections between Iraq, 9/11, and Weapons of Mass Destruction.

I wonder if Richard Clarke and Paul Wolfowitz have been interviewed by the special prosecutor. It may be enlightening testimony.

:Sigh: Stevens was threatening to RESIGN(over the bridge to nowhere they were voting to scrap). Our party should have jumped on this as an opportunity to show fiscal responsibility. This vote could have been a win-win if Stevens resigned over it. BTW it wasn't line item veto persay as much as it was to scrap pet projects in states (I believe 6 were on the chopping block)

I agree, but the question is then how does one get compensated if a loved one is killed by a fire arm? Who would be responsible? What if the police gunned down the perp or if he took his own life? These aren't exactly my positions. All I am doing is asking questions.

Your point about VCRs and Autos not being held responsible, points out this very important fact!


EVERY SINGLE other manufacturer of products in the USA, can be sued. Why NOT gun industry? why Should they be exempt from acts of negligence? Remember, things like, a gun barell blows up and burns the owner hand and face to pieces, if not kills him. This gun mfg is going to not be held responsible.
There is a line here also, between frivilous suits and true victims


And Colt and Marlin are in CT, but others, like S & W are in Mass. It would not be devastating to have them close. Marlin and Smith & Wesson were two of my clients when I was in the Ins. Industry and they really don't have all that many employees.

Siamese? I was ATTACKED by a Siamese cat when we were looking at a house 18 years ago. I had my then 6 mo old baby in my arms at the time the cat locked his jaw on my wrist and just hung there.

I got a bad infection from the puncture wounds. Had to stay in a sling, etc. I talked to animal control in that town about the incident. He said nothing could be done. Said the Siamese were trained to guard castles in Siam. Apparently, I was in someone else's castle :-/

Well, who would be responsible would be the criminal who pulled the trigger. If they had anything, they should loose it to the victim(s) who were shot. Any moneys in a bank, and property they have, should go to the victims to equal in value what ever the fine was imposed. Even garnishment of wages after they get out of the pen (if they do).

Here would be another scenario. What if someone walks in and buys a firearm legally, and nothing wrong with them. Let's say it was bought for a legitamate purpose like hunting. Next, the person takes a notion to sell it to another. The other person in the end kills someone with the weapon. Should then the manufacturer be sued or the first one to own the gun? The manufacturer has no way to control this and really the original owner didn't either. These gangs are notorious in using stolen firearms with the serial numbers removed. There's no way for a manufacturer to know where their guns are at they made. Neither are there no way for them to control this. That brings us back to the criminal element which are the true responsible party, or the way I see it.

The reason I mentioned an automobile as a weapon above was, what if someone ran over another with the intention to kill them. Should the victim or their relatives be able to sue the auotmobile manufacturer which wasn't behind the wheel of the car? It's the same thing, just the weapon was different.

What if someone would bash anothers brain out with a rock? Who would we sue then, mother earth? Or what about suing the property owner where the rock was located or obtained? That being impossible, the one who used the rock to kill would be responsible. This is just my opinion on the subject though.

I know it's getting late in the day, but Sandyh, if you're still here, the reason they rushed to war was because the inspectors had been re-admitted with license to go anywhere, anytime, and still were not not finding any WMD. So the WH figured that they better get the invasion under way before they lost the chance to go to war. You see that's what they planned to do from the day they took office. Schmucks, if they had any smarts, they would have realized that the presence of so many US troops in Kuwait, ready to invade was the perfect ploy. They could have persuaded Saddam to leave by keeping the pressure on. But than they wouldn't have been able to go to war. "War Presidents get re-elected." Schmucks!

I have no problem with the gun shield law. Using the commerce clause to protect a billion dollar industry is a legitimate use of the commerce clause. Using the commerce clause to protect school kids in other states is something else and was never intended by the framers of the constitution. With that said, individual states can enact legislation to protect our kids, but not congress.

While Jerry Kilgore said that he would use surplus state dollars (more than likely from excessive taxes that he, as the incumbent governor, irrationally imposed on the fine people of Virginia) to sponsor "community projects," surely he can't intend to mean executing people of the community with the same black-toothed grin of say, an Adolph Hitler, can he? Does he support the death penalty so much that he's willing to overlook potential miscarriages of justice? Do residents of Virginia want innocent people murdered in their name? Do we even care?

Still, while it is a noble goal to widen I-66, Democratic candidate Tim Kaine at least wants to make sure that every driver in Virginia, including those who live in DC and Maryland and elsewhere in the country, and those annoying tourists, pay their fair share and contribute to highway construction projects in the fair state of Virginia. This is the true intention of the gas tax.

Let's be honest. While Jerry Kilgore refused to endorse his own campaign ads, claiming that his "campaign approved this message," at least Tim Kaine has the courage and strength to stand up for himself.

And Tim Kaine makes no bones about it: he may not agree with the law he will enforce, but at least Virgina voters will know where he stands.

That type of honesty and courage and strength is to be commended and should be rewarded with your vote.

With respect to choosing a case that Ginsburg joined in on the dissent--I chose that case because it went in line with our conversations last night. If you want, I will post more cases but whats the point? The commerce clause is the central issue in all the cases. I was just trying to spotlight the issue and set it up for discussion. If you guys want to read case after case, be my guest (I dont have that much time).

I only got a chance to skim the posts but nobody argues that she doesn't do this. That is all I was saying.

Pam, I'm not sure about Netscape or compatable browsers (Firefox), if they will show those buttons. I run Opera and it does not. I think it's due to the webpage being in XML. Under Opera, we only get the comments box, URL box, Remember me, preview, and the post buttons. Opera don't show the new open thread box, neither did I see it in Slim Browser.

I tried Slim Browser today, which is just another user interface for the Internet Explorer engine DLL. It shows all of it (except the new open thread) where it's still IE, but a different GUI (graphic user interface). I wont use IE because of all the security flaws in it. It's 2X or more slower than Opera too. Generally Opera opens every page that's netscape compatible, but not for IE. Netscape wont open some IE stuff correctly either.

Wolfowitz fidgeted and scowled… "Well, I just don't understand why we are beginning by talking about this one man bin Laden".

Wolfowitz turned to me. "You give bin Laden too much credit. He could not do all these things like the 1993 attack on New York, not without a state sponser. Just because the FBI and CIA have failed to find the linkage does not mean they don't exist".

I could hardly believe it, but Wolfowitz was actually spouting the totally discredited Laurie Mylroie theory that Iraq was behind the 1993 truck bomb at the World Trade Center, a theory that had been investigated for years and found to be totally untrue.

Miller was asked about the June Meeting with Libby during her first grand jury appearance, and didn't recall it until Fitzgerald showed her secret service logs showing she had been at the White House Annex that day.

Evening Fellow Dems,

I was hoping to get some help. Over this past weekend I saw a poll that showed about 80% of Republicans are still staunch supporters of this administration and congress. I became so insensed that, inspired by Tom Paine, I penned an OpEd. Only problem was by the time I had finished I found myself at about 3000 words.

Well, since most major papers won't go above a thousand, and I can't see cutting the heart out of it to meet a size requirement, I was wondering if anyone might know of a blog or publication that might entertain a longer piece.

Tully, I have a little blog that very few people read so it's probably not what you're looking for, but I'd be happy to post it. I don't really know what the submission rules are like for these places but you might try submitting it to commondreams.org, informationclearinghouse.info, etc. you might try googling blogs on the subject your wrote and see what comes up and then write to them. or you could join dailykos or that type of place and post it yourself.

I just opened up a letter from Ohio Medicade a little ago. I found that not only will there be a co-pay on drugs because of Medicare, but because of new state laws, there will be co-pays on some services too!

Here's the co-pay services starting Jan 1 2006;

Non-emergency hospital emergency room service - $3.00 a visit

Dental services - $3.00 a visit

Routine eye services - $2.00 per exam

Eyglasses - $1.00 per fitting

Most brand name (non-generic) medications - $2.00 per prescription or refil.

Exceptions;

Younger than 21

Pregnant or pregnancy ended up to 90 days ago.

Living in a nursing home or intermeadiate care facility for the retarded

Getting emergency services in a hospital, clinic, office or other facility.

Getting services for family planing

Getting hospice care.

About the dental;

Dental coverage under Medicade for adults will be limited to:

Now folks, all this used to be free. Some only draw very small amounts, and these few dollars can come between paying their rent, eating, dental, or medicine. On the Republican side, two family embers of Forrester, Forrest and Brooke Schaaf, seem to be the leading blogging over at the Forrster blog. Even though they are both paid members of the Forrester campaign, by placing family members as your bloggers would seem to give you an outlet for saying whatever you wanted about Corzine, even that he is going to kill people, and yet still provide you with any political cover for these attacks. I mean, how dare Democrats attack Doug Forrester's family (even though Doug Forrester's family is being paid to attack Jon Corzine)!

That is pretty sleazy--using your family as paid attack dogs and as political cover for any attack you want to make on your opponent. Barf.

I was talking with my husband today and we were discussing the tone that conservative talk shows have taken on since Bush nominated Miers. One guys was even talking about wanting to impeach Bush because he is too friendly the Muslims and has placed a Koran in the White House.

What I don't understand is why they are so upset. The Bush's family is entrenched in the oil industry. In Michael Moore's documentary, he showed how far back Bush's family goes with the Saudis and the Taliban Government. Yet now they are shocked and dismayed he is so friendly with Muslims?!

And one more thing...don't they control every branch of this government? Didn't they win in 2004? So why are they got the same thing we got, and we lost? They are so quick to tell black folks that they are voting blindly while they pimp themselves for what? And when my husband and I try to tell who REALLY is in the party (fat cats, robber barons, etc....) they just don't get it.

Speaking of talking points memos, today on the Al Franken show, Tom Oliphant was telling how he mentioned a phrase he made up, "the crimalization of politics" in front of Tony Blankly and Pat Buchannon and how both their ears picked up. Then the next thing he knew, all the Repug talking heads on Fox and elsewhere were repeating it non-stop. (C) any act which is indictable under title 29, United States Code, section 186 (dealing with restrictions on payments and loans to labor organizations) or section 501 (c) (relating to embezzlement from union funds), (D) any offense involving fraud connected with a case under title 11 (except a case under section 157 of this title), fraud in the sale of securities, or the felonious manufacture, importation, receiving, concealment, buying, selling, or otherwise dealing in a controlled substance or listed chemical (as defined in section 102 of the Controlled Substances Act), punishable under any law of the United States,
(E) any act which is indictable under the Currency and Foreign Transactions Reporting Act,
(F) any act which is indictable under the Immigration and Nationality Act, section 274 (relating to bringing in and harboring certain aliens), section 277 (relating to aiding or assisting certain aliens to enter the United States), or section 278 (relating to importation of alien for immoral purpose) if the act indictable under such section of such Act was committed for the purpose of financial gain, or
(G) any act that is indictable under any provision listed in section 2332b (g)(5)(B);
(2) “State” means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, any territory or possession of the United States, any political subdivision, or any department, agency, or instrumentality thereof;
(3) “person” includes any individual or entity capable of holding a legal or beneficial interest in property;
(4) “enterprise” includes any individual, partnership, corporation, association, or other legal entity, and any union or group of individuals associated in fact although not a legal entity;
(5) “pattern of racketeering activity” requires at least two acts of racketeering activity, one of which occurred after the effective date of this chapter and the last of which occurred within ten years (excluding any period of imprisonment) after the commission of a prior act of racketeering activity;
(6) “unlawful debt” means a debt
(A) incurred or contracted in gambling activity which was in violation of the law of the United States, a State or political subdivision thereof, or which is unenforceable under State or Federal law in whole or in part as to principal or interest because of the laws relating to usury, and
(B) which was incurred in connection with the business of gambling in violation of the law of the United States, a State or political subdivision thereof, or the business of lending money or a thing of value at a rate usurious under State or Federal law, where the usurious rate is at least twice the enforceable rate;
(7) “racketeering investigator” means any attorney or investigator so designated by the Attorney General and charged with the duty of enforcing or carrying into effect this chapter;
(8) “racketeering investigation” means any inquiry conducted by any racketeering investigator for the purpose of ascertaining whether any person has been involved in any violation of this chapter or of any final order, judgment, or decree of any court of the United States, duly entered in any case or proceeding arising under this chapter;
(9) “documentary material” includes any book, paper, document, record, recording, or other material; and
(10) “Attorney General” includes the Attorney General of the United States, the Deputy Attorney General of the United States, the Associate Attorney General of the United States, any Assistant Attorney General of the United States, or any employee of the Department of Justice or any employee of any department or agency of the United States so designated by the Attorney General to carry out the powers conferred on the Attorney General by this chapter. Any department or agency so designated may use in investigations authorized by this chapter either the investigative provisions of this chapter or the investigative power of such department or agency otherwise conferred by law.

Here in the Palm Springs area we have big wind farms. You see them on TV whenever they set a piece out here. They are noisy, they do kill birds and they really mess up the view. But the generate a lot of power directly onto the grid. So it's a trade-off. Don't see it as viable out there in the ocean off Cape Hattaras. It's is a local issue, however, and should be settled locally.

I can find points of convergence between Domingo's ideas and my own. Because I see his point of view, I'm in a more broadly-informed position to be able to define my own views. We have disagreed in the past on some issues but he still keeps talkin and so do I. But I believe we understand each other on the matters that truly count.

The most important requirement of a free and civil democracy is first of all "TOLERANCE" of alternative view points. It is not wrong to express a view, and a view is not necessarily wrong in and of itself. A position that is taken in an argument is subject to attack and ridicule and -- as our democracy is defined -- if you can successfully defend your position, then your view should rule the day, provided of course that you can garner majority support for that position.

So Democracy has a two-fold problem: articulating a clear majority vision, and secondly, gaining majority support for it. That there is none and that there is disarray and still argument and debate is not necessarily wrong. Republicans will say that Democrats are "divided" and "have no coherent plan."

In some respects, that is true -- in absence of a unitarian and majoritarian articulation of America's plan, Dems will only just provide the fuel for Republican policies, and mostly just attack and point out how flawed and irrational Republicans' policies are. Democrats believe in debate and consensus, but that debate and consensus is not automatic. Our candidate will help us tie it all together come election time.

But Democrats need not onlhy ideological support for a candidate, but also financial support. Governor Dean ran a grass-roots policy of soliciting donations as little as $5.

In the long run, if folks see enough Republican attack ads and there is no sufficient and adequate response, then folks'll perceive the Democrats as weak, regardless of whether they have the right policies. But in a capitalist society, TV time, aka, attack time, aka, time for those who believe in us the strongest, only goes to those who can donate a couple of bucks here and there.

Personally, there is a few dollars charged to a credit account monthly. It is a small thing for me. But I believe that Democrats are the majority. As Jim Morrisson said, "They got the guns but we got the numbers." It is still true. There are more of us than them, but they redraw district lines and draw more contributions.

We can win if we believe not only with our hearts but also with our wallets. This is why so many Democrats have spoken out against the "bridge to nowhere" in Alaska, while opposing drilling in ANWR, which is scheduled to start soon.

Get on board the program and donate a buck or two to the cause, if for no other reason than to make sure that the Democratic opposition has a fair voice in making a case for the politics of this country. Without making a donation, you are tacitly supporting a totalitarianistic theocracy, since the Democrats need support to oppose the corrupt Republicans who believe only in cronyism, even if that means approving members of clergy who abuse your children with impunity.

POLAND SPRINGS is a town in Maine, but the water doesn't come from there. 40 miles away at a factory that pulls the good ol' H2O out of the Municipal pipes.

Hinkley Springs used to be called 'Hinkley & Schmitt" and had a lot of people buying it, until the FACT came out that they were just re-filtering Chicago City water. (Nothing wrong with that. I live in the Suburbs, and the NUMBER ONE thing the Realtors say is "Chicago Water")

Penn & Teller did a show about the water scam. Dasani is owned by COKE, and they just use their filtered water that they don't add sugar and caffiene to and sell it FOR MORE than Coke.

Same thing with Aquafina..That's Pepsi without the costly stuff.

60 Minutes, or 20 / 20 or one of those shows taped employees of distributors fillng bottles from fire hydrants. (THAT stuff IS NOT filtered).

Are there any method for you to get broadband?

The phone company have been resisting improving the technology for transmission though the land line. That's why cable and satellite are used for broadband. Cable modems can transmit at 4mb to 6mb per second. The landline is stuck at 100K for high speed internet assess, otherwise you are receiving and transmitting at 20K to 40K per second or 2 orders of magnitude (100X) slower than broadband. On satellite the uplink is slow because it is still phone line but the down link is very fast.

I get updates from MS or Adobe in minute for what use to take hours. The last 24mb update took less that 5 minutes.

I send a friend a picture that was 3mb and her system took 3 hours and the photo ended up fragmented. So I had to burn a copy to mail to her via snail.

Yes I admit this is my favorite time zone.

I can't even remember right now how many I've lived under. Always felt weird everywhere else. The sky always looked different and the air smelled different, etc! But once natural climatization took hold after a week or so I was fine.

October 21,2005 | WASHINGTON -- George W. Bush's rising political fortunes provided a windfall for Harriet Miers' law firm.

Campaign records show Bush's Texas gubernatorial campaigns paid Miers a total of $163,000 in legal fees, most of it for work done during the future president's 1998 re-election bid.

Some senators are planning to explore Miers' legal work for Bush during her confirmation process to be the newest Supreme Court justice, but the White House says it won't release any memos detailing that work.

"I think people across the country recognize the importance of attorney-client privilege," said White House spokesman Scott McClellan.


Reports filed with the Texas Ethics Commission show that two payments of $70,000 were made to Miers' Locke, Purnell, Rain and Harrell firm in Dallas within a month of each other during the 1998 campaign. Another $16,000 in payments were made between March and December 1999.

The 1998 totals dwarfed the $7,000 Bush paid Miers' firm during his first run for governor in 1994, and are extremely large for campaign legal work in Texas, an expert said.

"I'm baffled," said Randall B. Wood, a partner in the Austin firm of Ray, Wood and Bonilla, and former director of Common Cause of Texas. "I've never seen that kind of money spent on a campaign lawyer. It's unprecedented."

The amount received by Locke, Purnell for the 1998 Texas race approaches the national tab for the 2004 Bush presidential re-election campaign, when at least $191,000 was spent on lawyers, Federal Election Commission records show.

In 2000, the Bush presidential campaign spent about $365,000 on legal services, the records show.

The Associated Press reviewed Texas records between 1993 and 2000, although detailed reports weren't available for the last half of 1995. A state commission spokeswoman said the panel had planned to retain all of the records because of their historic significance when Bush became president, but some were misplaced.

Dana Perrino, a White House spokeswoman, said the legal fees to Miers' firm were for routine campaign work, but declined to be more specific. Presidential aides declined to say whether Miers ever worked on researching Bush's past, such as his military record.

A spokeswoman for Locke, Liddell & Sapp -- the firm created when Miers' office merged with another Dallas law firm -- said it wouldn't provide details on the payments, citing attorney-client privilege.

Former Texas Land Commissioner Garry Mauro, a Democrat who was defeated handily by Bush in the 1998 campaign, said both the amount and the timing of the payments are curious. In late September, when Miers' firm received the first of two $70,000 payments, Mauro said he trailed Bush in the polls by 35 points.

"If they're spending that kind of money," said Mauro, now an Austin attorney who estimates he spent less than $20,000 on legal fees during the campaign, "they're spending it to protect themselves from something."

A spokeswoman for Sen. Patrick Leahy of Vermont, the top Democrat on the Senate Judiciary Committee, said the panel plans to explore the legal work done by Miers' firm for Bush.

A questionnaire sent out last week by Leahy and Sen. Arlen Specter, the Pennsylvania Republican who chairs the committee, has asked Miers to "explain how you will resolve any conflicts that may arise by virtue of your service in the Bush Administration, as George W. Bush's personal lawyer, or as the lawyer for George W. Bush's gubernatorial and presidential campaigns."

Miers provided answers to the questionnaire earlier this week, but lawmakers rejected her answers as too vague.

I am not opposed to anti-sexual harassment laws. In fact, I just filed a lawsuit yesterday for a young girl who was sexually harassed by her boss who apparently thinks that it is ok for him to touch her boobs whenever he wants.

Second, Delay’s mug shot looks stupid. I know he was ordered by his lawyer to smile but gimme a break.

Good morning everyone! What a mug shot, huh? You know his peeps told him to make sure he had a rosy smile and a pleasant "I'm innocent" look. Honestly, I don't know how anyone can be a republican anymore the way their ship is unraveling. We are finding that the history of corruption has been so long that it would be hard to admit mistakes. I really don't think that democrats ever have had such moralistic, inhuman, predatory corruption. How the religious right supports these animals is so beyond me.

Good morning every all,

Isn't it interesting how history repeats itself? I am referring to the media's war of 1898, The Spanish American War, and our current fiasco in Iraq. The days of yellow journalism from 1870 to 1900, and 1980 to present. I miss the professional journalism envisioned be Henry Luce as he began Time magazine. The decade of the 1990's was too good, everyone was making money, henceforth, blue[blew] dress-gate. In 2001, the media saw this new war for its sensationalist value to sell the newspapers/TV ed-op-news shows/internet websites etc. I hope what comes out of fitzgerald's investigation is the truth; because it is the truth that sets us free.

Oh yeah, as for Karen Hughes, she ranks right up there with Katherine Harris as a ranking member of the Liars club.

Good morning, all.

Did you catch the photo Mathews used on Hardball last night as a backdrop for starting discussion on Plamegate. There was Libby and Cheney with who else but Harriet Miers standing between them in a sweet little photo opp.

I can't believe that the Republicans are going to put her on the Supreme Court when they know she's going to be called to testify in the Plamegate trials. Is there any institution in this country that they haven't desecrated?

Trent Lott has been tapped to be the MC . Lott opens the rally announcing, "Fellow Republicans, we're here today to show the world that George W Bush is not stupid as the Liberal Media tries to portray him. Ladies and Gentlemen, I present the President of the United States, George W Bush. " Bush comes out on the field to thunderous applause. Lott says, "Mr. President, let's show 'em that the Liberal Media is lying when they say you're stupid. What's the capital city of Missouri ?" Dubya pauses, scrunches up his face, then says, " Minnesota ? ". A collective sigh sweeps through the crowd. But then they begin to chant, " Give Dubya another chance, Give Dubya another chance ." Moveon.org has an easy way to send Letters to the Editor. You can write a custom letter or use their pre-done letters. Here's what I sent in regards to the reduction in spending (values) being proposed by the right -- is that white and right?

Where are the values? It is easy to spend $200B on a very questionable war, but cut the very programs that could help those not so fortunate. Education, health care, and food are the very things that can help lift folks out of the vicous cycle of poverty. AND therefore become tax payers.

The best place to cut are those areas of the defense that are not needed. That would be a lot more that $50B per year. And maybe the $B's slush fund for the President.

Where are the values?
