Convicted Felon Libby Running Free
President Bush's move to commute the sentence of convicted felon and former top White House aide Scooter Libby goes beyond the usual display of contempt for our system of justice we see from this administration.
It's not just because of the overwhelming public opinion in opposition to Bush's move. Americans are tired of this administration, and opposition to the White House is basically par for the course. It's not just because he thumbed his nose at our system of justice. Again, par for the course, as we've seen with the politicization of the Justice Department. It's not just because the White House dishonestly claimed the sentence was harsh, even though it was mid-range for sentencing guidelines. Once again, it's what we've all come to expect.
No, there are three main reasons why this goes beyond their usual contempt for the law:
- Scooter Libby was convicted for lying and obstructing justice while a top White House aide in order to protect others in the White House. After being convicted, the White House intervenes to protect him from prison without even claiming he was innocent. All this comes despite the "cloud over the White House" that Fitzgerald spoke about in his closing statement.
- President Bush completely ignored the Justice Department's Manual on Commutation. This sends the message that there's one system of justice for "loyal Bushies" and another system of justice for the rest of us. Here's the important section from the guidelines:
Requests for commutation generally are not accepted unless and until a person has begun serving that sentence. Nor are commutation requests generally accepted from persons who are presently challenging their convictions or sentences through appeal or other court proceeding.
- As Fire Dog Lake points out, "by commuting Libby’s sentence rather than pardoning him, Bush insures that Scooter will remain silent and be able to invoke the fifth before before Congress and not risk being cited for contempt."
Democrats aren't just going to take this lying down. To start, Rep. John Conyers will be holding hearings on the commutation starting next week. And we're going to keep the pressure on this administration and hold them accountable for this disgraceful move to free convicted felon Scooter Libby.

I was appalled when I heard the news that President Bush commuted the sentence of Scooter Libby. While I am sure Mr. Bush believes he is acting within his rights as the president, I think this decision is completely wrong. Mr. Libby had a fair and open trial that resulted in a legal conviction and sentencing. There is no reason that he should not have to serve his sentence as punishment for his crime.
When did it become acceptable for people who work for the U.S. government to reveal classified secrets such as the identity of an undercover agent? Last I knew, telling U.S. national security secrets was considered treason. Apparently, it became OK last night when Mr. Bush decided that one of his friends should not be held accountable to the same rule of law that applies to every other American citizen.
This administration has demonstrated time and again a total lack of respect for the U.S. legal system and for those of us who believe in it and try to adhere to it. We cannot have a functioning democracy if the executive branch continues to make up its own rules as it goes along. I am dismayed that Congress has allowed the Bush administration to get away with so much for so long.

The only thing I remember is that he can't pardon someone who has been impeached.
The reason Bush commuted Libby's sentence is because he couldn't grant a full pardon because that would have been a slap in the face for the Bush appointed prosecutor and the Bush appointed judges who convicted Libby and because Libby wouldn't of gone more than a week in jail before turning on Cheney and spilling his guts out to the world about everything crooked going on in the White House.
I noticed the only neo-cons speaking out about this situation are no-name Republicans. Every other top Republicans is keeping their mouths shut because they know it's going to hurt the Republicans in 08.
Not only is this an embarrassment to the Republicans but politically it helps the Democrats who stand for integrity, justice and accountability. It stands for qualities that the Republicans sorely lack.
As I remember it, the law was put in place so people can't commit crimes on behalf of the President and expect to be pardoned for their dirty work.
That's why GHWB had to wait until HE was President to pardon all those Iran/Contra crooks.

Mr. Conyers - please!!! I have enormous respect for you. But stop it with these hearings. They aren't getting anywhere. Just sign on to HRES 333. If Conyers signs on, I guarantee that HRES 333 will pass and the impeachment hearing of one Dick Cheney will proceed. Enough is enough.
Better still than contacting the White House - who doesn't care what you think (if they did this would have never been done), pick up the phone and called your Congressional Representation. Ask them to endorse HRES 333 (impeachment of Cheney). I just called Frank Pallone and I intend to call him every week at least once until he signs on. There is only way way to restore respect for the law at this point and that is impeachment.

I've written hundreds of thousands of words since the evening of December 12, 2000. On that night, upon hearing of the Bush v. Gore decision, I wrote something called "Not My President," and have been writing every single day since. In all the words written in essays, books, speeches, campaign letters, press releases, emails, along with a DU post here and there, I am proudest of one line that came to me in 2003:
"Blaming George W. Bush for all that has gone wrong in America is a lot like blaming Mickey Mouse when Disney screws up."

Besides being a decent snark, it has the added benefit of being true. A blogger I read last week had a great line that I recall now in paraphrase: The Decider decided to let Cheney make all the decisions. We knew this, we could see it, and thanks to some astonishing (albeit far overdue) reporting by the Washington Post, we have details and data to the dot.
Forget impeaching Bush. He almost certainly hasn't been making most of the heavy decisions on policy, which means he probably hasn't actually committed any crimes. Sins of omission and collaboration? Accessory to murder, fraud and grand larceny? Conspiracy to commit same? Sure, yes, clearly, but I don't have much interest in trying to convict a rubber stamp.
The analogy I think of when considering Cheney over Bush:
During the 19th century, ship-to-ship warfare on the high seas determined the fate of nations. Whenever possible, the cannoneers aimed for two spots on the enemy ship: the rudder, and the main mast. Take out either with a well-placed ball, and the enemy ship is defeated; no mainsail to catch the wind, and no rudder for tactical steering makes even the stoutest warship into a barrel of helpless fish.
Cheney is the main mast and the rudder. You want to shatter this administration's ability to do more harm? Impeach the wind and steering, and the whole lot of them will be helpless and immobilized. The case against Cheney must be made, but more than that, it truly can be made.

And because Bush is going to pardon Libby. Let's put Bush in a place where he doesn't have any power to stop the process and watch them all sqirm.
In a Vice Presidential impeachment trial all the usual suspects would have no executive privilege to hide behind. They would have to answer the questions or go straight to the slammer.
I'd actually prefer puttng them in the Bush family fishing boat and sending it out to sea without any Secret Service agents to rescue them when they run aground or smash into a iceberg...or al Queada fishes them out the sea.
We are in the middle of a slow summer news cycle. The 24/7 media would love to have a full scale impeachment trial to cover. And voters fed up with all the GOP incompetence would love to watch someone throw darts at Cheney.

First of all, Mary Winkler was defending herself against someone who would eventually kill her.
Secondly, Then Bill Clinton's impeachment for the same exact crime, i.e. lying to a grand jury , was not Fair??? I Didn't think so either!!
I wrote the note below to the White House this morning - not like it will do any good - but I was moved to do something. What will it take to wake people up that we have criminals running our country? When will truly "decent" people unite and actually DO something? When will the democratic party get some guts and LET THEM HAVE IT?! Look what they did to us and to Bill Clinton... wasting tax payers dollars over Bill's sex life! They went after him like rabid dogs. And we haven't done squat about all that this administration has done outside the law. Why? Are we as a party THAT weak, that complacent, that unmotivated? We allow them to sit in the White House after this insane war, and all of the administration's lies, crimes, and corruption...? We allowed them to TAKE the vote, we allowed them to take the country, to take our soldiers to war, to take our lives, our freedoms... when will we say ENOUGH is ENOUGH?? I say impeach them all! President Bush let Lewis Libby, the one man who was convicted for the lies around the Iraq war, go free.
And the obstruction of justice doesn't stop there. The Senate recently subpoenaed documents from the Vice President's office Dick Cheney around the illegal wiretapping program and so far he has not complied. It's clear this administration thinks it's above the law. That's un-American, and I think it's time for Congress to hold them accountable.

Your not the only one diffending Pres. Bush in issues of what I'd like to think of as a free aid, their last attempt towards free support was in the trial of error, "the fifth."
When looking into what is seen in the real world as "a correctional diffence," you can only imagine what it was like to have all eyes knowingly deny your attempt toward it.
I'm sure in ways of walking you'd know how to find your way around the walls of the free world, but their only means of communication are seen as fatal means of relation.

Scooter Libby is a good man who made one simple mistake. Compare that to all the mistakes Clinton made (the same ones over and over again. Monica, Linda Tripp, Jennifer Flowers, Paula Jones etc.) He was also disbarred from the Arkansas Bar for perjury and was ordered to pay $25,000. In October 2001, Clinton was suspended by the Supreme Court and, facing disbarment from the high court as well, Clinton resigned from the Supreme Court bar in November. (I talk about Clinton a lot because he is the democratic poster boy for liberalism). The point is, compare Scooter Libby's one mistake to Clinton's too numerous to count and what do you get? More corruption in the liberal democratic institutions than in the Republican ranks. You want to hang a man out to dry for one mistake but praise and honor another for more mistakes made than any other. It's because one is a Republican while the other is a democrat.
Libby is a criminal and that's a fact. The GOP wanted to impeach Clinton for no other reason than perjury. Now one of their own commits perjury and all we hear about is "there is no underlying crime". Pure hypocritical crap. No underlying crime? How about outing an active CIA agent. The truth is that Cheney and Bush came up with the plan. Libby acted on their orders.

Clinton did a lot more than lie to investigators during the Monica affair. Libby didn't out any CIA officers, he had nothing to do with the outing at all. He just panicked and lied about the facts. There were mistakes made, that's obvious. But having the guy hung out to dry for this is stupid, especially when much more serious affairs occurred in the other camp that have not been answered for, yet. The conviction itself sticks, the man can no longer practice law. I think that will hurt him more than going to prison because it hurts his livelihood. Let Libby go and be with his family. I think he deserves that much for his long public service to the country.
Cheney IS a good start on impeachment, because the trails will lead from him directly to Bush. They are so interlinked, that taking down one will take down the other.

I recently saw a bumper sticker that said, "Thank me, I voted for Clinton-Gore." So, I sat down and reflected on that, and I am sending my "Thank you" for what you have done, specifically:
1. Thank you for introducing us to Jennifer Flowers, Paula Jones, Monica Lewinsky, Dolly Kyle Browning, Kathleen Willey, and Juanita Broderick. Did I leave anyone out?
2. Thank you for teaching my 8 year old about oral sex. I had really planned to wait until he was a little older to discuss it with him, but now he knows more about it than I did as a senior in college.
3. Thank you for showing us that sexual harassment in the work place (especially the White House) and on the job is OK, and all you have to know is what the meaning of "it" is. It really is great to know that certain sexual acts are not sex, and one person may have sex while the other one does NOT have sex.
4. Thank you for reintroducing the concept of impeachment to a new generation and demonstrating that the ridiculous plot of the movie "Wag the Dog" could be plausible after all.
5. Thanks for making Jimmy Carter look competent, Gerald Ford look graceful, Richard Nixon look honest, Lyndon Johnson look truthful, and John Kennedy look moral.
6. Thank you for the 73 House and Senate witnesses who have pled the 5th Amendment and 17 witnesses who have fled the country to avoid testifying about Democratic campaign fund raising.
7. Thank you, for the 19 charges, 8 convictions, and 4 imprisonment's from the Whitewater "mess" and the 55 criminal charges and 32 criminal convictions (so far) in the other " Clinton " scandals.

I also appreciate removing all of that excess weight ( China , silverware, linen, towels, ash trays, soap, pens, magnetic compass, flight manuals, etc.) out of Air Force 1. The weight savings means burning less fuel, thus less tax dollars spent on jet fuel. Thank you!
13. And finally, please ensure that Hillary enjoys the $8 million dollar advance for her "tell-all" book and you, Bill, the $10 million advance for your memoirs. Who says crime doesn't pay!
14. The last and most important point - thank you for forcing Israel to let Mohammed Atta go free. Terrorist pilot Mohammed Atta blew up a bus in Israel in 1986. The Israelis captured, tried and imprisoned him. As part of the Oslo agreement with the Palestinians in 1993, Israel had to agree to release so-called "political prisoners". However, the Israelis would not release any with blood on their hands. The American President at the time, Bill Clinton, and his Secretary of State, Warren Christopher, "insisted" that all prisoners be released. Thus Mohammed Atta was freed and eventually thanked the US by flying an airplane into Tower One of the World Trade Center . This was reported by many of the American TV networks at the time that the terrorists were first identified. It was censored in the US from all later reports. Why shouldn't Americans know the real truth?

AND THE REST OF THE STORY Hillary Rodham Clinton, as a New York State Senator, now comes under the "Congressional Retirement and Staffing Plan," which means that even if she never gets reelected, she STILL receives her Congressional salary until she dies. If Bill outlives her, he then inherits HER salary until HE dies. He is already getting his Presidential salary until he dies. If Hillary outlives Bill, she also gets HIS salary until she dies. Guess who pays for that?

It's common knowledge that in order for her to establish NY residency, they purchased a million dollar-plus house in upscale Chappaqua , New York . Makes sense. They are entitled to Secret Service protection for life. Still makes sense.
Here is where it becomes interesting. Their mortgage payments hover at around $10,000 per month. BUT, an extra residence HAD to be built within the acreage to house the Secret Service agents.
The Clintons charge the Federal government $10,000 monthly rent for the use of that extra residence, which is just about equal to their mortgage payment. This means that we, the taxpayers, are paying the Clinton 's salary, mortgage, transportation, safety and security, as well as the salaries for their 12 man staff -- and, this is all perfectly legal!
When she runs for President, will you vote for her?

I fail to see that putting any Republi-lite in office is going to be any better for the American people that putting another Republican in office.

I feel that the Democratic party can do a hell of a lot better than Clinton. She's a non-contender as far as I'm concerned.
A better way to look at the Libby matter is to assume that the president did the right the thing in commuting his prison sentence - because the commutation and proposed pardon which Bush has not ruled out, make it clear that everything that Libby did (including lying to the prosecutor and the grand jury) was in accordance with the express instructions of the president and vice-president. The more they argue that they did the right thing for Libby, the guiltier they look. If anybody should be doing 2 and 1/2 years in jail, it is the president and vice-president. At the very least, Democrats should ask them to resign and make Nancy Pelosi president.
So here is another "in your face" challenge for the Democratic majority in Congress. And what are they doing? They're going to conduct hearings! Mull over it. Consider things. Investigate.
The grand Democratic scheme seems to be to live under the assumption that the Democrats will win the White House in 08 and just wait bush out in the mean time.
In the mean time bush can and will do unending damage to this country. And he will do it, just to show he can do it and that the Democrats are weak and can't stop him.
Some say he is the worst president the country has ever had. Yet with all the stupid, criminal, corrupt things he's done, he got himself reelected. In spite of an overwhelming public sentiment that he be impeached, the Democratic Congress is afraid of even trying.
History will not remember bush for being a bad president, it will remember him for suceeding in taking full advantage of an inept legislative body and an apathetic populace.
It is more disturbing to me that Democratic and Republican Senators are not yet enforcing their subpoena against the Vice President than that Mr. Libby was given a commutation. As others may recall, President Clinton issued a number of rather controversial pardons before he left office, so this sort of special favoritism from politicians is not unexpected by voters like me. (Which of course does not mean that I approve of this sort of thing by either President Bush or President Clinton, I don't!!!) But in my opinion, we are ENTITLED as citizens of this Republic to have our members of Congress actually seek to enforce Congressional subpoenas, especially when a sitting Vice President is so evidently ignorant of the law that his attorneys do not even understand that his office is actually a part of the Executive Branch of government. It is mindboggling to me that Democratic and even Republican senators in Congress have not acted on this issue yet. If they are reluctant to do so, they should resign so we can elect people who will enforce the law.
Is impeachment really off the table? I find it appalling that the Democrats will not broach the subject (oh, kooks and 3rd-tier guys like Kucinich have called for it, but it won't go anywhere without somebody of prominence backing it)...
Democrats must use this, and every other opportunity, to not only turn over the apple cart but chop it into little pieces, burn it, destroy it, and make it otherwise unidentifiable. If I ran the party, I'd find the contributors to Libby's legal defense fund and expose each and every donor for what they are: aiders and abettors.
It's time to shove the smear campaign back in their faces. Make them smell it. Inhale it. Digest it. And loathe that they were ever a part of the Repugnican party.

Where was all the Democratic ire and outrage when Rep. William J. Jefferson (D-La.), was videotaped accepting $100,000 in $100 bills from a Northern Virginia investor who was wearing an FBI wire. Ah, that would be an actual crime in the real world my blind liberal whiners.
A few days later, on Aug. 3, 2005, FBI agents raided Jefferson's home in Northeast Washington and found $90,000 of the cash in the freezer, in $10,000 increments wrapped in aluminum foil and stuffed inside frozen-food containers. How was this Congressman rewarded for his crime, thus-far he has avoided prosecution and sits on one of the most prestigious committees in the Congress. Was he given a pass because he was Black or because he was a Democrat?
On August 11, 1999, President Bill-the-pill-Clinton commuted the sentences of 16 members of Fuerzas Armadas de Liberación Nacional (Puerto Rico) FALN, a violent Puerto Rican nationalist group that set off 120 bombs in the United States mostly in New York City and Chicago, convicted for conspiracies to commit robbery, bomb-making, and sedition, as well as for firearms and explosives violations. They were sentenced with terms ranging from 35 to 105 years in prison for the conviction of conspiracy and sedition. Scooter Libby did not set off any bombs or kill anyone!
Pardons and commutations signed on final day in office
Clinton issued 140 pardons as well as several commutations on his last day of office (January 20, 2001). When a sentence is commuted, the conviction remains intact, but the sentence can be altered in a number of ways. Some controversial actions included the following:
• Carlos A. Vignali had his sentence for cocaine trafficking commuted, after serving 6 of 15 years in federal prison. Scooter Libby neither took nor sold drugs!
• Almon Glenn Braswell was pardoned of his mail fraud and perjury convictions, even while a federal investigation was underway regarding additional money laundering and tax evasion charges. Braswell and Carlos Vignali each paid approximately $200,000 to Hillary Clinton's brother, Hugh Rodham, to represent their respective cases for clemency. Hugh Rodham returned the payments after they were disclosed to the public, oh darn, we almost got away with it. Braswell would later invoke the Fifth Amendment at a Senate Committee hearing in 2001, when questioned about allegations of his having systematically defrauded senior citizens of millions of dollars.
• Marc Rich, a fugitive, was pardoned of tax evasion, after clemency pleas from Israeli prime minister Ehud Barak, among many other international luminaries. He was required to pay a $100 million dollar fine and waive any use of the pardon as a defense against any future civil charges that were filed against him in the same case. Critics complained that Denise Rich, his former wife, had made substantial donations to the Clinton library and to Mrs. Clinton's senate campaign. According to Paul Volcker's independent investigation of Iraqi Oil-for-Food kickback schemes, Marc Rich was a middleman for several suspect Iraqi oil deals involving over 4 million barrels of oil. Knowing Bill Clinton’s background with women, I bet money that Denise Rich, very good-looking and well shaped, gave Bill Clinton a little more than a donation.
• Susan McDougal, who had already completed her sentence, was pardoned for her role in the Whitewater scandal; McDougal had served 18 months on contempt charges for refusing to testify about Clinton's role. [I love Bill]
• Dan Rostenkowski, a former Democratic Congressman convicted in the Congressional Post Office Scandal. Rostenkowski had served his entire sentence.
• Melvin J. Reynolds, a Democratic Congressman from Illinois, who was convicted of bank fraud, 12 counts of sexual assault, obstruction of justice, and solicitation of child pornography had his sentence commuted on the bank fraud charged and was allowed to serve the final months under the auspices of a half way house. He had served his entire sentence on child sex abuse charges before the commutation of the later convictions. Now there’s a man who needs to be back on the street.
• Roger Clinton, the president's half-brother, on drug charges after having served the entire sentence more than a decade before. Roger Clinton would be charged with drunk driving and disorderly conduct in an unrelated incident within a year of the pardon. He was also briefly alleged to have been utilized in lobbying for the Braswell pardon, among others. However, no wrongdoing was uncovered. Key word, uncovered. Well Roger it appears you will be on your own from now on.
And let’s not forget the Whitewater scandal, Travel gate and all the women who happened to just show up from all over the country and testify they were sexually assaulted by Clinton. Barack Obamma is correct in recently stating: ‘why should the Democratics run someone who was in or so close to all the past corruption.’
Now let’s see: George Bush had a former drinking problem, may or may not have served in the National Guard his whole era and commuted the sentence of Scooter Libby. Hmmm, which one has the better chance at getting his glass house shattered? I am well sure after you liberal spin-masters get a hold of the facts it will be Bill Clinton once again who the saint is. Lying, cheating and stealing are fine in American Politics as long as the proponents are all Democrats.
If most of you die-hard Democrats would do a study down through political history on corruption and politics you find the Democrat Party and corruption are synonymous.
…and they all dropped their rocks and had a very left day.
