House Passes ENDA

I think Governor Dean said it best, so I'll just pass along his words from earlier on this historic day:

This is an historic day for our Congress and our country. After more than three decades of debate, the new Democratic Congress today took a profound step toward fairness and equality by passing the Employment Non-Discrimination Act. The guiding principle of our American democracy is a deep and abiding commitment to promoting equality under the law for every single American. Unfortunately, even though large majorities of the American people and American businesses oppose workplace discrimination, it is legal today in 30 states to fire someone simply because of his or her sexual orientation. This bipartisan bill corrects that injustice by making it illegal to fire, refuse to hire, or otherwise discriminate against employees simply based on their sexual orientation.

The significance of today's victory is highlighted by the fact that it comes just one day after voters in states like Kentucky and Virginia rejected mean-spirited, anti-gay attacks by desperate Republicans who tried and failed to use equality as a wedge issue. I am proud that those shameful efforts by Republicans failed once again, and I am proud to lead a Party that continues to fight for equality. In just the last year, our Democratic Congress has turned its back on the Republican Party's divisive marriage amendments, passed a hate crimes law, and has now passed ENDA. As we move forward, the Democratic Party will continue to fight for equal rights for every American, including our friends and family in the transgender community.

I suppose Larry Craig will vote against this; and if the Senate would somehow vote to pass it, Bush will veto it?

This is great news for people of alternate sexual orientation. However, does it strengthen the rights of single fathers that are trying to raise their children, and are forced into the cold corporate world of working every shift under the moon no matter the affect upon their child(ren)? Does it close the loophole that employers in forty-three "at-will employment" states currently enjoy. That is, the loophole that makes it legal for them to deny hours, or offer employment in a different area of their employ because of this "guaranteed employment clause"?

These are both real assaults upon the working class because both have been employed to bring my, and my son's, life to a virtual halt. As we all should know life doesn't stand still, so the so the borderline illicit actions of two corporate employers in my life have induced much pain for my son and I to bear.

In regards to the at will employment claim I have the paperwork that shows the HR Assistant stating that they are an at will employer and they do not have to offer the hours in which I applied. It was a pretty lame excuse to get this corporate employer out of paying Unemployment Insurance, but it also opened the precedential door of legally not obligating to not have to offer any hours to anyone based upon the At-Will Employment statute.

This is a totally, totally wrong interpretation of the at-will employment statute, which is only an employment disclaimer that states that employers cannot guarantee lifetime employment. Of course, this is only natural, employers cannot tell the future economies are fickle at best, and employers needed some protection against the overzealous supervisor expressly tauting about the current financial health of a company and arrogantly projecting that the company, and henceforth, the employees jobs would be there forever. At will employment was never meant as an exclusionary tactic to allow any employer to circumvent paying unemployment insurance. I wonder how many more people this is happening to because I doubt it is just me.

I do one one thing, and this too sounds pretty lame by today's social standards, but I do know that God in heaven knows of all the lies. You see, all of these liars throughout our society, and government for that matter, are great indicators of why we truly need to believe in a much higher heavenly authority. Because without that authority life in general will evolve to a state of chaos; it is written!


Now that I wrote this nice long post maybe I can edit and revise it into a letter to the State Senator/Assemblyperson here in Maine where the at will decision took place. It's not going to help my much because it's been over seven years, but maybe I can get a loop hole plugged so others will not have to go through what we have. Thanks for listening! Oh, you didn't? Well, ya wouldn't want to be in our footprints!

We should be about making each person that pays taxes, represented by the Government. The
wealthy should pay their fair share. This will put more money into circulation and all, even the wealthy, will create more wealth. The poor will have a little easier life. The middleclass will increase all the more. Was this God's plan when he said do good to your neighbor and comfort the weak?
