This is how the Red States govern themselves:

Idaho ranked a dismal 44th in the nation in an "integrity index" released by the Chicago-based Better Government Association.

Idaho's score was a mixed bag — its whistleblower law tied for ninth in the nation, while its open meeting law ranked 44th. But Idaho's low ranking can be attributed in large part to lawmakers who have been unwilling to police themselves.

Idaho was one of one three states to score a "perfect" zero on conflict-of-interest issues, a well-earned mark. Idaho legislators — citizen lawmakers who spend nine months of the year working their day jobs — are not required to file reports saying who they work for, who their clients are, or where they invest their money.

bush is having his piglets rush through as many ways to screw the environment, workers, etc. as possible at the last minute. but according to this page from kos there is a way to undo all this crap...i reprint some of it below so we can all be educated about it and begin to push each and every congressional rep and senator to get on this as soon as the swearing in is over....otherwise regulations that were fought for over decades will be wiped out by these evil friggin monsters:

The Congressional Review Act set up a process in which Congress has 60 session days to review and possibly reject agency rules...

If a Congress member finds a rule objectionable, he/she can introduce a "resolution of disapproval."

The Act prescribes special expedited procedures, which limit debate in the House and ban a Senate filibuster, for consideration of the resolution...

If the motion to disapprove passes in both the House and Senate, and is then signed by the president, the rule essentially disappears. Even if it has already taken effect, the agency that issued it can no longer enforce the regulation or defend it in court. Furthermore, the agency is banned from pushing a similar version of the rule at a later date.

The Congressional Review Act has only been used once in the 12 years since it was enacted. Hopefully it will be used about 130 times when the 111th Congress convenes in January. Unless that would be too un-post-partisan-like..."

you know, i often wonder why these Blue dogs don't just call themselves centrist republicans!
looks like they got spanked!

In a stinging rebuke of the Blue Dog caucus, Henry Waxman has defeated John Dingell for Chairmanship of the House Energy and Commerce Committee.

Why, it seems like only yesterday the conservative Blue Dogs were sniffing that the Steering Committee which recommended Waxman were a bunch of unrepentant hippies who didn't reflect the overall makeup of the Democratic caucus. (In fact, it was.)

This is a huge defeat for the Blue Dogs, who have become the primary recipients of the massive corporate donations which used to flow to the Republicans. They were were hoping to use Dingell as a roadblock to keep any meaningful change from happening with regard to issues under the Committee's jurisdiction -- telecommunications and health care, energy and environmental protection, interstate commerce and consumer protection.

Hey GregL, when you come in, yes, I went to the funeral of my past boss. The Giant Catholic cathedral was packed, with people standing in the back and around the sides. A great many people wanted to pay tribute to what was one of the most integral, finest men ever born. It was funny, praying for the salvation of his soul, when he was so close to the perfect man. He was a true success in his life and career. The world was a better place with him in it.

ya know i have to run but a final thought. rush won the senate majority for us back in 06 with his mocking of parkinson's disease victims and this year he helped us take the white house with his focus on having republicans cross over and vote for hillary and so forth....it will be really to his credit if we not only have obama as president but hillary as sec of state....funny though the other day rush was complaining about democrats having crossed over to give mcbush the nomination....ya just never know how things will turn out do ya??

They lost in every way imaginable, on every political front. The symbol of their anti-gay crusade, Colorado congresswoman Marilyn Musgrave, was beheaded. The party that had made so much hay running against Mexicans saw noted anti-immigration crusader Bill Sali of Idaho ousted along with several other members of the Immigration Reform Caucus. The GOP's grasp on the so-called "moral values" issue likewise went up in roaring flames, with Rep. Vito Fossella of Staten Island the poster child — his morals were once so perfect that he refused to be seen with his gay sister, and now he's a national joke, bounced after being caught drunk driving and having unprotected, babymaking sex with a married Air Force officer.

The Democratic majority does not exist without the Blue Dogs. And while we are a minority within this party, as the vote you cite indicates, I respectfully remind our liberal Democrat colleagues that there will not be a single piece of legislation that is passed without the majority support of the Blue Dog caucus. Remember who your friends are. And calling your friends "Republicans", especially in this political climate, is not conducive to friendly relationships which is necessary for good governance.

There is a grassroots movement that started a couple years ago, voted in Obama and is continuing to swell!

I have high hopes for an Obama administration, watching him choose his cabinet. He is choosing a lot of old Clinton people, and we all know how sucessful that 8 year era was. It will be good to return to Peace, Prosperity, Security, Environment interest, and international respect.

Good afternoon, all!

Well, as Rev, Bill once said, the defacation has just hit the ventilation.

2 MEGA car dealerships in the area have shut their doors due to lack of buyers who can't get loans because the banks aren't parting with 1 cent of that $700,000,000,000.00 that Paulson threw their way.

These places ran full page ads in all the newspapers and advertised heavily on all the local TV and radio stations.

That means all those media companies will see a loss of revenue starting this week.

All the salesmen, bookkeepers, finance people, mechanics, body shop crew, parts department workers, valets, and all the rest are suddenly out of jobs.

I guess the Pug "trickle down" theory does work. The only thing wrong with it is that only the misery is trickling down.

Nov. 20 (Bloomberg) -- Pope Benedict XVI was the first to predict the crisis in the global financial system, a ``prophecy'' dating to a paper he wrote when he was a cardinal, Italian Finance Minister Giulio Tremonti said.

``The prediction that an undisciplined economy would collapse by its own rules can be found'' in an article written by Cardinal Joseph Ratzinger, who became pope in April 2005, Tremonti said yesterday at Milan's Cattolica University.

German-born Ratzinger in 1985 presented a paper entitled ``Market Economy and Ethics'' at a Rome event dedicated to the Church and the economy. The future pope said a decline in ethics ``can actually cause the laws of the market to collapse.''

Pope Benedict in an Oct. 7 speech reflected on crashing markets and concluded that ``money vanishes, it is nothing'' and warned that ``the only solid reality is the word of God.''

The Vatican's official newspaper, l'Osservatore Romano, on the same day criticized the free-market model for having ``grown too much and badly in the past two decades.''

My Main contention with the Blue Dogs and other Democrats that feel they should be Centrist,is this. To me, it is a matter of mis-information that the constituents vote in these guys on. NO Democrat has ever said they are going to take away guns. Every Democrat has recited that Abortion should be rare, but available as a choice, and education is the first key to decreasing it. Democrats ARE christians, Republicans try and pretend they are not in an effort to win their own votes.

All the good things about this country were put in place by Liberal left wing Democrats. If only everyone knew that.

Oh, it's not a matter of whether the jobs are for American workers, Bob. I mean privateering. Hiring Halliburton to build roads, bridges, etc. Hiring Blackwater to provide security. Slashing the federal budget of protective agencies like the FDA and the EPA and allowing corporations to police themselves, run their own drug trials, write their own reports on the environmental hazards for their projects. The jobs are here in the U.S., but they are not being performed by the people to whom WE have entrusted the duty. Instead we pay, with our common wealth, corporations who have no accountability to us, whose responsibility is to make a profit for the shareholders and the board and not to protect and empower the population at large. This must end. All the things that were wrought by FDR and his successors, all the good that was done, all the things taken for granted by "Joe the American" are in danger of being swept away.

The Blue Dog Coalition - who celebrated 13 years of leadership in 2008 - has built a reputation as a serious player in the policy arena, promoting positions which bridge the gap between ideological extremes. Many of the group's policy proposals have been praised as fair, responsible, and positive additions to a Congressional environment too often marked as partisan and antagonistic.

The 47 conservative and moderate Democrats in the group hail from every region of the country, although the group acknowledges some southern ancestry which accounts for the group's nickname. Taken from the South's longtime description of a party loyalist as one who would vote for a yellow dog if it were on the ballot as a Democrat, the "Blue Dog" moniker was taken by members of The Coalition because their moderate-to-conservative-views had been "choked blue" by their party in the years leading up to the 1994 election.

The Coalition was formed in the 104th Congress as a policy-oriented group to give moderate and conservative Democrats in the House of Representatives a common sense, bridge-building voice within the institution.

Most agree that, since then, the Blue Dogs have successfully injected a moderate viewpoint into the Democratic Caucus, where group members now find greater receptiveness to their opinions. In fact, the continuing political success of "Blue Pups" in the 1998, 2000, 2002, 2004 and 2006 elections points to the public's approval of the centrist, fiscally responsible message represented by The Coalition. Since 1996, 24 Blue Dogs won their seats by defeating a Republican incumbent.

The Coalition has been particularly active on fiscal issues, relentlessly pursuing a balanced budget and then protecting that achievement from politically popular "raids" on the budget. Past Coalition budgets have won the endorsement of the nonpartisan Concord Coalition and multiple newspaper and magazine editorials. As one column pointed out, the Blue Dogs have proven that "common sense, conservative economics and compassion aren't necessarily mutually exclusive."

Blue Dog Coalition proposals have served as middle-ground markers which laid the foundation for the bipartisanship necessary to bring about fundamental reforms, and helped set into law policies reflecting the "common sense, conservative compassion" so often attached to the group's efforts.

In the 110h Congress, the Coalition intends to continue to make a difference in Congress by forging middle-ground, bipartisan answers to the current challenges facing the Country. A top priority will be to refocus Congress on balancing the budget and ridding taxpayers of the burden the debt places on them. The group also expects to be involved in a variety of issues, where the stale extreme left vs. right approach requires a breath of fresh air.

GregL, that statement is a bit vague as to the question you asked however, I would hope, and lobby for, a bit of patriotism injected into policy positions and decisions.

Free fall. The U.S. has lost private sector jobs for 10 straight months. One quarter of all businesses in the U.S. plan to cut payroll over the next year. Retail sales fell in October by the largest monthly drop on record. Auto sales have collapsed, driving the auto companies towards the precipice. Unemployment is up to 6.1 percent, with most analysts predicting it will soar past 8 percent over the next year. (That translates into unemployment among young minority men at rates of 50 percent or more). States are now facing $100 billion in deficits in operating budgets for the next fiscal year. Twelve million homes are "under water," worth less than their mortgages. The U.S. has joined Germany and Japan in what is becoming a global recession.

"The era of big government is over" is over. In the crisis, we are, as Richard Nixon once said, "all Keynesians now." Former Clinton Treasury Secretaries Robert Rubin and Lawrence Summers, until recently notable deficit hawks, now call for substantial fiscal stimulus - deficit-funded federal spending - to get the economy going.

Summers, whose alliterative guidelines for this year's earlier $150 billion stimulus - "timely, temporary and targeted" - helped to fix its mistaken focus on tax rebates, has changed his consonants. Now he says the stimulus should be "speedy, substantial and sustained," noting that some estimates on Wall Street have gone as high as "$500 to $700 billion." Rubin agreed, saying "we need a very substantial stimulus," while mumbling about needing to reduce the budget deficit over the longer run.

A major recovery program - featuring substantial public investment - will be inevitably the first initiative of the Obama administration. It should feature more spending than tax cuts - investing in renewable energy and conservation, in rebuilding everything from schools to bridges to a smart electric gird, in helping cities and states avoid crippling cuts of services, in keeping college affordable, providing health care to children, and aiding those most in need.

Our public investment needs can easily use the money. A stunning report by Eric Lotke at the Campaign for America's Future details the staggering investment deficits that have accumulated over the last 30 years. For decades, we've chosen to cut taxes on the wealthy while starving vital public investments. The result is an America that is literally falling apart, while much of the private wealth was squandered in the speculative frenzy that now has leveled our economy. Rather than adding to that folly, we should be focusing on strategic public investments that will put people to work in the short term while contributing to a more competitive economy, a better-educated citizenry and a cleaner environment.

While we agree in principle, it was President Eisenhower that started the Interstate Highway system. Only Nixon could go to China, President Ford ended the Vietnam War, and Presidents Reagan and Bush oversaw the collapse of the Soviet Union. Now while that sounds like an ad the GOP should be running it does make my point. To say all good things came from liberals is a bit ingenious, IMHO.

Then we agree wholeheartedly. I hope the Blue Dog Caucus agree with us since they're the ones with the votes that count. I don't have any problem with some privatization as long as the subject is not national security and as long as it is American companies, based in the U.S., and using American employees. I have no problem with capitalism, as I'm sure you don't either, however, to me, well-regulated capitalism is the smartest way to go.

HELENA - U.S. Sen. Jon Tester has not yet made a decision on the proposed $25 billion auto industry bailout, according to a release from his office Wednesday.

The first-term senator asked the three auto executives who appeared this week at a Senate Banking Committee hearing whether they'd be willing to accept a salary of $1 per year until their companies become profitable, according to a release from Tester's office about his remarks. The executives suggested they'd be amenable to that plan.

According to an article published Thursday in the New York Times, "Iran has now produced roughly enough nuclear material to make, with added purification, a single atom bomb, according to nuclear experts."

And where do the experts get their information from?

"The figures detailing Iran's progress were contained in a routine update on Wednesday from the International Atomic Energy Agency, which has been conducting inspections of the country's main nuclear plant at Natanz. The report concluded that as of early this month, Iran had made 630 kilograms, or about 1,390 pounds, of low-enriched uranium."

However, all hope is not lost...

This is why it's so important that the talks between the two sides succeed, for Israel's sake too. A negotiated settlement would be the best solution for Jerusalem. Not only because Israel has concerns about Iran's nuclear program. Also, because a US rapprochement with Iran in such a scenario, and the confidence building, could help find a solution over disputes in Lebanon and Gaza.

If talks fail, the US could also take unilateral sanctions, the most powerful of which could be sanctions against the Iranian Central Bank (Bank Markazi). With oil prices falling, and reports that Iran will face a $60 billion budget deficit next year, this may force Ayatollah Khamenei to take negotiations seriously.

One can not also help but notice that such reports help those who want a military solution. This may not be around the corner; however, it is there. Even when Obama enters office.

Many have accused the Democrats of being too timid and too compromising. That's not true. The difference with them is that they are likely to give negotiations a serious chance, before reaching out for their guns. And if they do, they won't do it alone. Just ask Slobodan Milosevic.

This article is from our good friends in Israel. As you can see, they are quite nervous about Iran having a nuclear weapon and righfully so considering the Iranian rhetoric. But like us, they are hoping for a negotiated solution. I sincerely hope President Obama is capable of a negotiated peace settlement with Iran, which I believe he is for the reasons cited in this article, because the alternative could very well be WW3.

Henry Paulson's $700 billion plan to save the world is dead or dying, but the bailout was not killed by his arrogance or his grossly misleading claims about what the public's money would buy. The plan collapsed because it didn't work. The Treasury secretary has launched a PR offensive to revive his falling influence. Too late. The Democrats should be equally embarrassed. In September their leaders in Congress rushed to embrace the Paulson solution, no hard questions asked. They now claim they were duped.

Paulson's squad at Treasury pumped $250 billion into the largest banks, buying their stock at inflated prices on the assumption it would persuade investors to step forward with their capital too. Instead, savvy financial players realized Paulson was spitting into a high wind, trying to save a system with stout talk.
Here is the ugly, unofficial truth that neither Wall Street nor the government will acknowledge: the pinnacle of the US financial system is broke--with perhaps $2 trillion in rotten financial assets on the books. Nobody knows, exactly. The bankers won't say, and regulators won't ask, or at least don't dare tell the public. Official silence naturally feeds the conviction that banking's problems are far worse than we've been told. The Levy Economics Institute of Bard College puts it plainly: "It is probable that many and perhaps most financial institutions are insolvent today--with a black hole of negative net worth that would swallow Paulson's entire $700 billion in one gulp."

The scale of this disaster explains why the Treasury secretary had to abandon his original plan to buy up failed mortgages and other bad assets from the banks. If government paid the true value for these nearly worthless assets, the banks would have to write down huge losses or, as Levy economists put it, "announce to the world that they are insolvent." On the other hand, if Paulson pumps the purchase price high enough to protect the banks from losses, $700 billion "will buy only a tiny fraction of the 'troubled' assets."

Paulson was trapped by these circumstances (and his own mendacity). Each time he tried to change the script, market insiders became even more alarmed. Congress is trapped too. So is President-elect Obama. From the outset of the crisis, the essential fallacy shared by governing influentials has been a wishful assumption that quick interventions with tons of public money would somehow restore the system to "normal" without disturbing free-market principles. Again, I am no cheerleader for the GOP; far from it. The Interstate Highway System had been in the planning stages since the 1930's and was originally designed for use only by the Government and the Military. After WWII there was a need to move building supplies to GI Bill housing developments so it was finally started. It was never supposed to enter downtowns of cities, it was only supposed to get to the edge of the major metropolitan areas.

Once Congress got hold of it, though, it somehow managed to grow so that it traversed every Congressional District except 2 or 3.

The Chinese opened the door through Ping Pong Diplomacy

Ford just happened to be sitting around when the Fall of Saigon happened. He had nothing to do with ending that war, just like Nixon happened to be President when we landed on the moon.

Reagan had NOTHING to do with the collapse of the USSR. He just kept the same policy started by Truman, as did every other President. In fact, after the Iron Curtain fell a bunch of Russian Generals said that, Reagan actually prolonged the inevitable with his Military build up and constant saber rattling. This forced the hard liners in the Party to become more entrenched and dig in a lot deeper.

Poppy Shrub didn't do a damn thing to hasten it either. The USSR was bogged down in a protracted unwinnable ground war in Afghanistan and it bled their economy dry. Their money was worthless and the net result was a Country that spanned 11 Time Zones that couldn't provide the basic necessities for its people. Like toilet paper.

The ONLY thing the Pugs are good at is myth making.

"Meaningful Welfare Reform" had it's beginnings back in 1969 when government funds were set aside so that young women could avoid or end unintended pregnancies.
These programs showed a 'direct' rate of return of $3 for every $1 spent and an incalculable (?spelling) rate of savings in social programs, youth detention programs, as well as prision savings. Studies show that the vast majority of violent crimes are committed by adults who grew up in poor homes where they were unwanted and therefore subjected to neglect and abuse.
Think about the money and the lives that have been saved by programs that the Republicans since Reagan have systematically gutted and denied 3rd world countries.

McCain Pollster Explains Loss, Calls Frank Luntz A Moron

The chief pollster for John McCain's presidential campaign offered a candid diagnosis of how his candidate was done in, on occasion reserving harsh words for fellow Republicans.

Bill McInturff, speaking at a National Journal breakfast on Thursday, said the political environment for the GOP in 2008 was worse than anything he has seen in his time polling since former Soviet empires were breaking the shackles of communism.

"Reporters would call me up and say, 'have you ever seen this?'" McInturff said of George W. Bush's approval ratings. "And I say, 'yeah, Bulgaria 1992.'"

"We had a very unpopular war and the most unpopular president in American polling history," he explained, by way of summarizing the election. "We had a 70 percent wrong track and we were winning. We were winning. And what happened? We said that's not hard enough for John McCain. We should implode the financial markets. And what happens? We go from 70 percent wrong track to literally 90 percent."

Unrestrained by the formalities of the election, McInturff levied some sharps words at fellow GOPers who -- generally speaking -- never really were bullish on the idea of a McCain presidency. The most biting jabs were saved for communications guru Frank Luntz.

"I saw Frank Luntz," said McInturff, "who is a moron -- I want to make sure this is clearly on the record -- he was talking to Republican governors, making fun of John for not being able to use a BlackBerry. The man can't do it because he is much more disabled than people can imagine... I would like to take a hammer and start breaking bones in Frank's arms."

McInturff later noted that the Obama campaign ran an ad on this very topic, and vice presidential candidate Joe Biden criticized the spot because of its insensitivity.

In addition to going after Luntz, McInturff highlighted several factors that he credited with truly hurting the McCain candidacy. The first, and most obvious, was the crisis in the financial markets and the failure of the House of Representatives to quickly pass a bailout packaged.

"As Sarah Palin settles back into her job as the state's chief executive, a new ethics complaint filed Tuesday says she's already improperly mixing her official duties and broader political ambitions," the Anchorage Daily News reports.

The charge: That Palin broke state ethics rules by holding national television interviews about her run for vice president from the governor's office.


The complaint comes as Palin's personal life, her prospects as a future presidential candidate and everything she says and does continues to draw headlines.

Zane Henning, a North Slope worker from Wasilla, said he filed the complaint with the attorney general. He says Palin is promoting her future political career on state property, pointing in particular to the governor's Nov. 10 interview with Fox News Channel host Greta Van Susteren.

"The governor is using her official position and office in an attempt to repair her damaged political image on the national scene," Henning wrote.

The Palin camp, besieged by interview requests, said the governor was no longer a candidate at the time of interviews, but otherwise had little to say about the complaint.

"The consideration of complaints under the executive branch ethics act is a confidential process, by law," wrote Palin spokesman Bill McAllister.

I will never forget how I felt two weeks ago when I watched Barack Obama celebrating with more than a hundred thousand in Chicago, tens of millions across our nation, and millions more around the world. Now, Congress has to ensure that we live up to the possibility of that day, and the promise of this moment in history.

As Democrats, our first job is to remember where our majority came from. We did not just make full-blown ideological converts of the other half of the country. What we did do _ and this in itself was a huge accomplishment _ was convince majority-making independents that we will govern responsibly and effectively at a time of national crisis. The 33 new members of Congress coming to Washington to swell our side of the aisle are pragmatic, not dogmatic. They were elected on promises of bipartisanship and fiscal discipline.

With their help, Democrats are a true national majority party for the first time in decades _ and if we want to stay that way, we must govern like one. Voters have little patience for majorities that pursue narrow, partisan agendas to the exclusion of common-sense accomplishment. As Speaker Nancy Pelosi has said, we must govern from the middle, welcoming debate in our own ranks and reaching out to Republicans, as well. That is what we did in the last Congress, when 70 percent of the major pieces of legislation passed with significant bipartisan support.

Of course, Republicans have to be willing to reach back. Instead, they may choose to pursue a strategy of obstruction, especially when so many conservatives are blaming the media, blaming moderates, blaming everyone but themselves for what happened on Nov. 4. In the immediate future, with no governing responsibility and with the moderate Republican virtually extinct, the other party is likely to move even further away from the centrist and independent voters who sustained its majorities.

But that wouldn't just be bad for Republicans _ it would be damaging for our country. We need a loyal opposition to engage constructively on legislation, to challenge Democratic arguments and hold us to account...

The only purpose served was the soothing of their religious consciousness which has no place in public policy. over the last 28 years the republicans have managed to talk americans out of traditional pension systems and into 401k plans and these are now on average worth about half of what they were a few months ago. people are shocked and scared and depressed.

we need to rethink our priorities as a people. we should put the establishment of a baseline of income for all people ahead of the rights of the few to gather obscene amounts of wealth. a good place to start would be to take about 399 million of that fat ass rush analcyst boys 400 million dollar contract and redistribute it to disabled soldiers who won't be able to earn much in their lives....i'm sure fatso would be pleased to help out after cheer leading the war of choice as he has...next up t-bone pickens needs to become slim pickens by giving up most of his wealth for funding the swift boaters who brought us the past four years of bush economics and carnage....and so on until as michael says in the godfather....all the family business is taken care of....

Mukasey's speech Thursday night was one of the longest and most strongly worded of his tenure. In it, he railed against those who criticized the Justice Department for sharply changing its focus after the Sept. 11 attacks from a prosecutorial agency to one that keyed on preventing future attacks -- even if that meant not charging some suspected terrorists with crimes and not prosecuting them in federal courtrooms like the one he presided over.

"As the end of this administration draws near, you would expect to hear broad praise for this success at keeping our nation safe. Instead, I am afraid what we hear is a chorus with a rather more dissonant refrain," Mukasey's prepared remarks said. "Instead of appreciation, or even a fair appraisal of the administration's accomplishments, we have heard relentless criticism of the very policies that have helped keep us safe. We have seen this in the media, we have seen this in the Congress, and we have heard it from the legal academy as well."

morning peaceman and gregg,

The wind started yesterday and blew from about 0700 yesterday until midnight last night. i came home about noon and found my gate about to blow off the hinges so I drove my truck up to the gate to support it propped and walked the 600 feet to my house. About a month ago the wind ripped apart the gate actuators which I just had repaired. I should just say screw the gate.

It is now 25 and calm, still no rain or snow and as dry as an Ohio oil well.

bush said we signed the Iraq agreement the other day. I hope that Iraq did not roll over about holding our people responsible for crimes in Iraq. I think the Congress should approve or disapprove this agreement on our side but bush apparently has no plans to do so. He's the decider. We will be the deciders sending him to the Hague to be tried , found guilty and hanged.

January 21 cannot come soon enough.

JUDGE RICHARD LEON just got the kind of lesson you can't learn in law school. At least not if you want a Bush appointment. Last seen denying Guantánamo Bay inmates the right to challenge their detainments, Mr Leon was over-ruled by the Supreme Court. Today Mr Leon ruled that five of six detainees exercising their restored habeas corpus rights were detained without merit. He ordered the men freed "forthwith". Demonstrating that justice remains free of fear or favor, Mr Leon then asked the government to waive its right to appeal.

The lesson, and hopefully all those who might need it are already seated on the federal bench, is that habeas is the foundation of justice precisely because the executive branch should never be trusted. These men spent nearly seven years imprisoned (and were mentioned during George Bush's 2002 state-of-the-union address) based on the strength of a rumour. Since that time, the administration blocked their release with iterative ridiculous legal arguments, including the one Judge Leon originally upheld. At least he finally faced up to the truth. The New York Times reports that some consider an appeal likely.
