Medical condition of the 4th amendment is upgraded.

Since the election of GW Bush in the Fall of 99', the 4th amendment has been in critical condition in intensive care. The medical bills are going to be astronomical. Today, a masterful surgeon, masquerading as a judge in Oregon, performed miraculous surgery and the amendments condition was upgraded to 'guarded'.

The surgeon went on to say, " We're not out of the woods yet, careful monitoring will be required until January of 09'".

Here's a snip from todays WAPO-

"For over 200 years, this Nation has adhered to the rule of law -- with unparalleled success," Aiken wrote in a strongly worded 44-page opinion. "A shift to a Nation based on extra-constitutional authority is prohibited, as well as ill-advised."

Guarding our constitution may be the one thing we accomplish with this election. Judging by some of the answers last night, we have a big job ahead of us, to make sure the person we nominate for the presidency has a clear cut idea of what Americans stand for.

I wish I felt I could trust the Supreme Court to uphold the Constitution, but I don't. Since 2000, when they ruled that declaring Bush the victor in a timely fashion was more important than counting the vote accurately, I've been uneasy. I'm furious we put up such an enemic fight over Roberts and Alito. I think their recent rulings show they were completely disengenuous when they testified about their respect for legal precident. Furthermore, in order to challenge an unconsitutional law, there must be an actual case brought. With the Military Commissions Act, which blatantly violated the Constitution's prohibition against limits to habeas corpus, how is someone denied habeas corpus rights able to bring a lawsuit?

I'm not sanguine about the 2008 election restoring our Constitution either. A new administration has so many reasons to "put the past behind us", I don't expect the abuses of our current administration will be effectively repudiated. Just saying, "we won't use the powers that Bush has claimed" does not prevent someone claiming them in the future.

The clearest way to restore the Constitution is through impeachment. That says, "when you cross this line, you've gone too far and you're out". Is there any doubt that Bush and Cheney have gone too far? Their actions have been wildly unamerican. Will those who side with them survive their next elections when the extent of the Bush Administration's crimes are spelled out?

Of course it will be appealed, probably put on the fast track. It's my hope the Roberts court will show the same courage as when it over ruled this administration in the past. I can only hope that Chief Justice Roberts will realize the impact his tenure may have on this nation and his legacy may hang this nations survival in the balance. The old saying goes that the longer a justice serves the more progressive he becomes. Lets hope so.

The Rehnquist(sp) court surprised me and the nation on 2000. Historically they had been all about supporting states rights and Bush v Gore was a 180 degree spin.

Regarding impeachment...I know and you know it's the proper thing to do, I'm afraid we'll have to let investigations go forward. We do need the smoking gun and I don't know how to articulate that YET. For the good of the nation, I hope it comes soon. Impeachment is the least that should happen to Bush/Cheney.

No impeachment is in the mind of the politician and the leadership of this party in Washington DC
